Your participation in the use of this website is conditional on your acceptance of the terms and conditions and privacy policy contained in this Agreement. The WEBSITE OWNER RESERVES THE RIGHT TO CHANGE THE TERMS AT ANY TIME AND WITHOUT NOTICE TO YOU. All website users must be at least 16 years old.

By purchasing our products, You were given a reasonable notice that these Terms and Conditions of Use existed. By moving forward with Your purchase of any of our products or membership, you implicitly agreed and continue to agree to abide by these Terms and Conditions of Use, as well as any disclaimers and privacy disclosures contained in these Terms and Conditions of Use. You agree You are at least 18 years old or of age in our applicable jurisdiction to access Your purchases. Access of purchases and related materials by a minor is a violation of use, and We reserve the right to terminate Your access if such an issue is discovered. 

Limited License 

Any and all materials, paid or free, that You access on this or any related domains are the sole ownership or licensed use of Charmaine Mischel Design Agency We own Our page layout and design, overall look and appearance, individual graphics, icons, videos, logos, taglines, and trademarks (common law or federally registered) unless otherwise stated. You are only receiving a limited, non-transferable, non-exclusive, revocable license for non-commercial use only in order to access any content or materials in the products You have paid for or opted to receive.  If you violate this license by giving or selling a copy of Our downloadable or digital product(s) to anyone, We reserve the right to send You a bill for the licenses you have sent to others and revoke your access to Our template(s)/product(s) permanently. 

You may: 

• Access Your purchases for Your personal use or use in Your business for non-commercial purposes. 

• Download and/or print any purchases for Your personal use or in Your business for non-commercial purposes. 

You may NOT: 

• Re-sell or trade Your access to Your purchases. 

• Share Your purchase with anyone else who has not yet purchased it or opted in to receive it. 

• Reprint or republish any of your purchases, in part or in whole. 

• Distribute any of the materials contained in Your purchases or related materials and/or communications as Your own, otherwise known as stealing. 

• Reproduce and tweak any part or whole of Your purchases for distribution as Your own work. • Claim ownership or use over any of Our intellectual property without Our prior consent, which includes (but is not limited to): copyrights such as coaching/course materials, worksheets, workbooks, lessons, videos, and more; trademarks such as names, logos, taglines, or other unique source identifiers; or trade dress including the look and feel of any of Our offerings (and its related communications and materials). 

• Use Our offering or any related materials and/or communications in an unlawful way or for any illegal or unlawful purpose(s). 

• Harass, or otherwise disrupt the coaching experience of others in any Charmaine Mischel Design Agency | Position To Presell | Label Launch Blueprint | Designpreneur Network website, platform or coaching portal. Doing so will result in immediate termination within ONE (1) day of incident, and you will surrender your access to the digital product(s), and will NOT receive a refund under any circumstances.

You have no right to privacy by accessing Your purchases or related materials, and We reserve the right to disclose Your participation in the same.

No Warranties

You agree that programs, products, services, or program materials are provided “as is” and without warranties of any kind either express or implied.  Specifically, Charmaine Mischel Design Agency | Position To Presell | Label Launch Blueprint | Designpreneur Network does not warrant that the programs, products, services will always be available, be uninterrupted, be error free, meet your requirements, or that any defects in the services will be corrected, or that any part of the website, or content are free of viruses or other harmful components. 

Limitations of Liability and Indemnification

Earnings Disclaimers 

We make no income/financial claims, nor guarantee of any kind regarding the potential income that can be generated through our communications or your participation in the purchase of any of our products. Past results are not an indication or promise of your results. Therefore, We cannot guarantee Your success merely upon access or purchase to Our offering(s) or related material(s). 

Refunds 

We want you to be satisfied with your purchase, therefore there are circumstances where you can get a refund, per the policies below. If you purchase any Label Launch Blueprint | Position To Presell coaching program, and you don’t like what you see AND you have not accessed more than THREE (3) individual digital lessons inside Label Launch Blueprint | Position To Presell, to get a refund for your membership, contact Charmaine Mischel Design Agency | Position To Presell | Label Launch Blueprint | Designpreneur Network at info@cmdesignagency.com within the first 7 days from the date you purchase and let us know if you would like a refund.  We will NOT provide refunds for purchases made more than 7 days following the date of purchase. ADDITIONALLY, we will NOT provide refunds if you have accessed more than THREE (3) digital lessons within those 7 days, no matter which of the lessons you accessed. When we refund you, you will surrender your access to the digital product(s). 

Chargebacks 

In the event of a chargeback attempt, You expressly agree to forfeit any and all of Our materials afforded to You in exchange for Your original purchase. We reserve the right to present proof of Your access to THREE (3) lessons and these Terms and Conditions of Use to the financial institution investigating the dispute. 

Recurring Payments

If You have signed up for a payment plan, You hereby authorize Our continued access to Your financial information stored by Our third-party financial processing company referenced in this Agreement until Your payment plan is complete, as set forth in Your acceptance of the purchase terms upon checkout. 

Jurisdiction 

This Agreement or any dispute arising from this Agreement is governed by the laws of New York without regard to provisions of conflicts of law. 

Severability 

If any provision is found to be invalid, the remaining provisions will be in full force and effect. 

Certification 

You certify that you are at least 18 years of age and that your answers to the registration materials on Charmaine Mischel Design Agency | Position To Presell | Label Launch Blueprint | Designpreneur Network will be truthful. Waiver 

The failure of Website or Website Owner to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.  Any waiver of this Agreement by Website or Website Owner must be in writing and signed by an authorized representative of the Website Owner. 

Entire Agreement 

This Agreement along with the privacy policy below constitutes your entire Agreement with Charmaine Mischel Design Agency | Position To Presell | Label Launch Blueprint | Designpreneur Network with respect to any products, purchases, goods or services.
